HB 173

LC1495
Shane A Morigeau (D) HD 95
Revise consent laws for elementary or high school students in a school setting

  1. RVS asks that the County support this bill.
According to current Montana state law, it is not a crime for school employees or volunteers to have sexual relationships with students who are 16 years or older. This bill would change the law to say that students cannot consent to sex with school employees or volunteers, regardless of what age the student is. The current law outlines other situations in which adults can abuse their power over minors, but school settings are absent. A student should be protected from being groomed by someone who has authority over them whether they are on probation/parole, in a mental health or community-based facility, or at school.
