  1. Per Karen Hughes: This bill will remove the public hearing requirement for phases from 76-3-617, known as phased subdivisions. The phasing statutes, as they currently stand, are flawed; we understand from stakeholders there is little interest in amending the phasing statutes. The problem with SB 33 is that it creates potentially conflicting processes with the final plat process in 76-3-610. That could be cleaned up, but there isn’t really a path to amending the proposed bill in a way to address the larger flaws of the original legislation. Our recommendation is to either oppose SB 33, or do not testify in support. If SB 33 moves forward, then we might want to consider suggesting amendments to address the practical problems it creates.

    Senator McConnell,

    Missoula County opposes SB 33, Revise subdivision laws, up for hearing this afternoon in the Local Government Committee. The bill creates potentially conflicting processes with the final plat process in 76-3-610 and removes the public hearing requirement for phases of phased subdivisions. While the current phasing statutes are flawed, SB 33 further complicates the process.

    Please oppose SB 33.
