Revising laws regarding temporary orders of protection

  1. RVS asks that the County support this bill. Endangered minors should be reported to Child and Family Services so that their case is properly evaluated and investigated.

    1. Due to the fact that orders of protection can be petitioned for and granted pro se individuals can obtain one without having any other contact within the broader criminal justice or social services systems. Therefore, cases involving abuse of minors may be seen that would not have any other way of being refereed to CFS by a mandated reporter. For example: A teen is being abused by noncustodial dad and has never told a doctor, teacher, or social worker. The teen seeks an order of protection against dad and the court is the first official entity to know about the abuse the teen is experiencing. The court reports this to CFS. The case can now be evaluated and investigated.

  2. The Montana Association of Clerks of District Court has no concerns with this bill relative to the duties of the Clerk of District Court.
