Per Adriane Beck: This bill only affects the duration of a state-declared disaster or emergency by extending the current time limits from 20 days, for a governor-declared emergency, to 30 days, and for a state-declared disaster from 30 days to 45. This bill does not have an impact on a city or county’s authority to declare an emergency or disaster. This bill was drafted at the request of MT DES to be more consistent with other states in FEMA Region 8. At this time- no position.

    Senators Sands and Bennett,

    Missoula County supports SB 90, Revise laws on declaration of emergency or disaster, up for hearing tomorrow morning in the Judiciary Committee. While it would not impact a city or county’s authority to declare an emergency or disaster, it would extend the current time limits on a state-declared emergency from 20 days to 30 days, and extend the limit on a state-declared disaster from 30 days to 45 days. This would resolve the issue of the governor having to declare an emergency/disaster twice for an ongoing, prolonged situation, which has become common with recent fire and flood events. The bill would also help Montana become more consistent with other states in FEMA Region 8.

    Missoula County supports SB 90, Revise laws on declaration of emergency or disaster, on the Senate floor this afternoon. While the bill would not impact a city or county’s authority to declare an emergency or disaster, it would extend the current time limits on a state-declared emergency from 20 days to 30 days, and extend the limit on a state-declared disaster from 30 days to 45 days. This would resolve the issue of the governor having to declare an emergency/disaster twice for an ongoing, prolonged situation, which has become common with recent fire and flood events.
